It depends on where you live. In an incorporated area (town/city) generally yes. An issue though is in a city the enforcement of these kinds of things can be low priority, an HOA is generally more effective from that standpoint.

I personally chose to live in an incorporated city but not an HOA. There are city ordinances with actual real government representation and force of law behind them for serious health and safety concerns but we can paint our houses whatever
