I think it makes sense to say training on material you legally acquired is fair use. Copyright, quite famously, doesn't protect ideas. Nobody really needs or wants AI models to reproduce verbatim copies of books or images or whatever,

I think there's a big problem with including an "untossed salad" in bounds. This is asking for trouble. Is an unbaked cake a cake? Obviously not. "Unbaked" is describing how it DIFFERS from a cake. An untossed salad

Money has to do with whether you can make the game. Games are regularly funded by many non-profit options such as co-ops or grants, etc. Developers are free to make games however they want.

Huh? Comparing model quality is something everyone is constantly doing here. If you need more specifics, it speaks in an incomprehensible way, stops working lazily, does a bad job and misses things constantly, and makes a lot more mistakes.
