I think landlords are not liable in this case. It is like if tennant sets building on fire. It just violates all sorts of codes. For landlords worst are dogs. With wooden floors soaked with acidic urine, all surfaces scratched and chowed. T

This assumes user is the only person with physical access to unlocked phone. All sorts of goverment agencies, airport security, even teachers now have access. And such attacks can be trivially automated, so even low paid worker can do it.
