Other instances of Mastodon can make their own decisions in terms of banned content, and other instances can choose to not federate with them.

Mastodon.social would ban them, and if other instances don't police content sufficiently then Mastodon.social doesn't have to federate with them.

I believe the English-language term is "letter of the law" for literal interpretations and "spirit of the law" for interpretations based on what something is meant to do.

Reason being it's a semi-private beta, not public release. Invite-only lets them ease into managing a larger userbase and the associated content.
