That was our initial justification/rationalization too... They were public facts. It'd be like repurposing the current temperature. But apparently that's not the case here. They actually own the rights to these facts and they had court case

Exactly. I'm not sure what the lesson was in that article... Most everyone has competition. The real task is determining and articulating (to your team and your customers) what makes you better. If you can't do that you're screwed.
