Operating system is complex project that consists of many elements. Kernel is one of them and it is written in C and assembler. What you write is truth but it doesn't apply to kernel.

Actually GCC for Windows target is like pain in the ass. Look for how many problems ReactOS had with it. Also this would need SEH to be implemented. Clang gives that out of the box.

That's actually true. While, LLVM/Clang is better compiler, I definitely would expect some example here.

I don't know but similar can be found on https://wiki.winehq.org/Clean_Room_Guidelines "Don't look at ReactOS code either (not even header files). A lot of it was reverse-engineered using methods that are not

I think they just live in EU. They also mention some EU directives related to reverse engineering.
