Constitutional law is so much more complicated than, "this is what the document says". What is happening is here is reprehensible, but I don't think you will find any defense against it in due process.

The title is inaccurate. Many of the records where from State run retirement programs, but not everyone affected is/was a state employee. Texas is a big place. The Teacher Retirement System of Texas(one of the affected organizations) alone

The key here is that the data is obtained via a 3rd party. Once you as an individual share any information with a 3rd party you lose any expectation of privacy. In the digital world there are specific carve outs for email, but not much else
