It's silly to the point where I read someone defending our right to use cryptography under the second amendment. It should be part of it's own modern bill of rights or something so there is no ambiguity.

It's as bad as when the government wanted to classify cryptographic algorithms as munitions. To make the argument I think it's best to fall back to a right to privacy under the 4th amendment, and to the fact that it's just math which anyone can do.
