You can. The way this works is via something called money. Or more generally, financial incentives, kickbacks, you name it. Using the UK as bad example, which it is, does not excuse the EU being bad too (or rather here, the EU commission).

I think since it is a for-profit project it is not exempt. At the least it would not make any sense otherwise. I also agree that this is now a mess. Courts will lateron find that such exemptions make no sense, since it is unfair to Windows
