That's a great theory, but what are the actual limits? Why not introduce throttling to everyone at once only at times of actual spikes instead of forcing me to sit through a week of having an essentially useless phone until the billing cycle goes through? More importantly, why the hell are millions of people paying for something that they were promised but aren't getting?
