Im am not a lawyer but as far as I know ,it depends on you jurisdiction and the exact code in question. Many legal systems don't know "fair use" and by default you have effectively zero rights to do anything with copyrighted materials without explicit permission. The license will tell you what is allowed (and If its a standard one you can assume it is in accordance with the law)
