Do first sale protections apply to physical things? I thought first sale was an intellectual property / copyright thing.
- hn_go_brrrrr 4y agoIt absolutely applies to physical things. If I buy a widget you sell, I can do anything I want with it, including resell it.
- celestialcheese 4y agoYup. Most recently, see Impression Products, Inc v Lexmark where the Supreme Court held that the initial sale of cartridges exhausted lexmarks patent rights and thus couldn't prevent 3rd parties from refilling.
