What are the consequences for abusing DMCA? Should they be stiffened?
- indymike 5y agoThere's little recourse to fake DMCA complaints. The reason the DMCA exists was to placate content owners who wanted a way to get infringements taken offline quickly. There does need to be something done about fake complaints - this is especially affecting creators, journalists (I'm including small time bloggers and vloggers in this group) and others who can't afford an army of lawyers to protect a small revenue stream. The problem is that it will be hard to get anything done because bigger media companies will loby to get even more power than they have today.
- dazc 5y agoAgree, DMCA works just fine when large sums of money are not at stake.
- appleflaxen 5y agothere is a societal cost to fake takedowns to silence speech, even when large sums of money aren't at stake.
