I'm a happy Protonmail user and I think this (even if it were true) is only an issue if you are being unrealistic. All companies can be legally compelled to take action regardless of their jurisdiction. If you have some gratuitously paranoid threat model, you should be using Tor anyway. I like their service much more than GMail and I feel much more comfortable with regard to data privacy when using it.
